With the filing deadline for non-provisional taxpayers fast approaching, the South African Revenue Service (SARS) is keeping its communication to taxpayers friendly. The message is clear: submit your tax return by 23 October 2026 to avoid penalties.

The SARS reminder may be friendly, but the consequences of missing the deadline are considerably less so – starting with administrative non-compliance penalties, levied monthly and ranging from R250 to R16,000 per month per outstanding return, depending on the taxpayer’s taxable income. And the longer the non-compliance persists, the more costly that missed deadline could become.
What Happens When Taxpayers Fall Behind on SARS Requirements
Administrative penalties are not the only consequence of not complying with SARS obligations.
Tax debt, amounts legally due to SARS, carries its own consequences. Where tax debt remains unpaid, SARS has various enforcement measures available under the Tax Administration Act. These include issuing a final demand which affords taxpayers 10 business days to either settle the outstanding amount or respond to SARS and initiating debt collection proceedings against taxpayers who fail to settle their outstanding obligations.
SARS may appoint third parties, including banks and employers, to recover outstanding amounts directly from funds held on behalf of or payable to taxpayers.
In cases where the final demand is not responded to within the prescribed 10 business days, or the outstanding debt remains unpaid, SARS may pursue further legal recovery measures, including civil judgments and the attachment of assets. While the measures available to SARS are subject to the applicable legal requirements, it also demonstrates that continued failure to address outstanding tax obligations can have consequences beyond the initial administrative penalties.
Taxpayers who disregard their filing obligations, sometimes unintentionally, may face additional financial consequences. Even if your tax return ultimately has a nil tax liability, SARS may still require you to submit a tax return.
What Should Taxpayers Do
With less than two weeks before the 2026 filing deadline, non-provisional taxpayers should review their SARS eFiling profile, confirm their filing obligations and ensure that all required returns are submitted within the prescribed timeframe.
It is equally important to ensure that all relevant income information forms part of your tax return and supporting documentation is available, particularly where you receive income from multiple sources or have circumstances requiring additional disclosure.
The proactive SARS reminders provides taxpayers with an additional opportunity to address their filing obligations before the deadline and avoid the financial and administrative consequences associated with non-compliance.
Failure to meet the deadline will result in administrative penalties and further SARS enforcement for non-compliance. Taxpayers should therefore take the necessary steps to ensure that their tax affairs are in order, before the deadline of 23 October 2026.
